Know the Facts Before You Agree to a DHR Stipulation
In Alabama, the Department of Human Resources (DHR) may ask you to sign a 'Stipulations to
Dependency' agreement. This may seem like the 'easiest' way out-but it can have long-term, serious
consequences for your family.
You have the right to a hearing. Don't waive it without understanding the impact.
Make DHR do their job. Make them prove their case.
A stipulation to dependency is a legal agreement that says you accept the court's finding that your
child is "dependent" under Alabama law. That means you agree-on record-that your child isn't
receiving proper care due to neglect, abuse, or abandonment.
When you sign this, you're giving the court the power to:
- Let DHR supervise your parenting
- Remove your child from your home temporarily or permanently
- Place your child with relatives or in foster care
- Order you to take parenting classes, drug tests, or other services
This is not a small thing. It's a legal admission with real consequences-some of which could haunt
your custody status for years.
Too often, DHR offers a stipulation like it's a 'quick fix' to avoid court. But signing it can actually
make things worse. Here's why you should consider pushing for a court hearing instead:
- DHR must prove their claims in court. Without your signature, they're required to provide evidence.
Make them do it.
- You have the right to challenge false or exaggerated allegations. Don't give up that right.
- Signing makes their job easier-not yours. You are not required to agree to DHR's version of the
story. Let the facts come out in court.
- The judge may find DHR hasn't met their burden. But you'll never know if you give up your hearing.
You have a legal right to a court hearing. Use it.
DHR is a powerful agency, but they don't get to decide your future on their own. If they've filed a
petition, demand a hearing. Let them present their case and let the judge decide based on facts-not
pressure.
- Ask questions.
- Speak with a lawyer.
- Don't sign anything you don't fully understand.
Make them do their job.
Make them earn their paycheck.
Don't do their work for them.
